Terms & Conditions
1. Definitions
1.1. "Photographer" refers to Mark Holland, trading as Mark Holland Photography.
1.2. "Client" refers to the individual(s) booking the photography session.
1.3. "Session" refers to the scheduled dog photography appointment.
1.4. "Images" refer to all photographs taken during the Session.
2. Booking and Fees
2.1. A non-refundable booking fee of £25 is required to secure the Session date and time. This fee will be deducted from the total cost of the services.
2.2. The remaining balance is due within seven days of the Session. No Images will be released until all payments are received in full.
3. Cancellation and Rescheduling
3.1. If the Client needs to reschedule, a minimum of 72 hours notice is required. The Photographer will make reasonable efforts to accommodate the new date, subject to availability.
3.2. Cancellations made less than 72 hours before the Session will result in the forfeiture of the booking fee.
4. Client Responsibilities
4.1. The Client is responsible for the behaviour and welfare of their dog(s) during the Session. The Photographer reserves the right to terminate the Session if the dog's behaviour poses a risk to any party or property.
4.2. The Client must disclose any behavioural issues or special requirements of their dog(s) prior to the Session.
5. Liability
5.1. The Photographer is not liable for any injuries, damages, or losses that occur during the Session. The Client agrees to indemnify and hold the Photographer harmless for any claims arising from the dog's behaviour.
5.2. The Photographer shall not be liable for any indirect loss or third-party claims occasioned by delay in completing the work or for any loss to the Client arising from delay in transit.
6. Artistic Licence
6.1. The Photographer retains artistic discretion in selecting the poses, locations, and styling of Images. The Client acknowledges that the Photographer's work is subjective and that the final Images may vary from expectations.
7. Copyright and Usage
7.1. The Photographer retains all copyright to the Images. The Client is granted a non-exclusive, non-transferable licence for personal use only.
7.2. The Client may not use the Images for commercial purposes, enter them into competitions, or alter them without the Photographer's written consent.
7.3. When sharing Images on social media, the Client agrees to credit the Photographer appropriately and not to remove any watermarks or logos.
8. Model Release
8.1. The Client grants the Photographer the right to use the Images for promotional purposes, including but not limited to, advertising, portfolio display, website, and social media, unless otherwise agreed in writing prior to the Session.
9. Image Delivery and Storage
9.1. Proof galleries will be made available within 14 days of the Session and will remain online for 14 days for selection and ordering.
9.2. Final edited Images will be delivered within 14 days after the Client's selection and full payment.
9.3. The Photographer is not responsible for the archival of Images beyond 2 months after delivery. Clients are advised to back up their digital files upon receipt.
10. Gift Vouchers
10.1. Validity. Gift vouchers are valid for a period of twelve (12) months from the date of purchase, unless otherwise stated. All photography sessions must be booked within this validity period. Expired vouchers cannot be redeemed, extended, or refunded.
10.2. Vouchers may be redeemed for the specific photography session described at the time of purchase. If a session of equal value is available, vouchers may be exchanged at the discretion of Mark Holland Photography.
10.3. Vouchers must be redeemed by booking a session in advance, subject to photographer availability. Outdoor sessions include a complimentary consultation to plan the session.
10.4. Vouchers are transferable and may be gifted to another recipient.
10.5. Vouchers purchased prior to any future price changes will remain valid for the session type listed at the time of purchase.
10.6. Vouchers may not be resold, exchanged for cash, or redeemed for any service other than that specified at the time of purchase without prior written agreement.
10.7. If a voucher code is lost, it may be reissued at the discretion of Mark Holland Photography upon provision of proof of purchase.
10.8. No refunds or partial refunds will be provided where the full value of the voucher is not used.
10.9. The purchase of a gift voucher constitutes the purchase of a standard photography package as described at the time of voucher purchase. All terms and conditions applicable to that package — including but not limited to session scope, inclusions and exclusions, rescheduling, cancellation, image usage, and delivery — apply equally to any session booked using a voucher.
10.10. Redeeming a voucher does not alter or extend the terms of the original package in any way. The recipient of a voucher agrees to be bound by the full standard terms and conditions associated with the package for which the voucher was issued.
11. Governing Law
11.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England, and any disputes shall be subject to the exclusive jurisdiction of the courts of England.
12. Complaints
12.1 Any complaints should first be raised by the client with the photographer in writing within 14 days from the date of receipt of images.
13. Agreement
13.1. By booking a Session with the Photographer, the Client agrees to all the above Terms and Conditions.
The Photographer reserves the right to amend these Terms and Conditions without prior notice.
